(\u201Cwe,\u201D \u201Cus,\u201D or \u201Cour\u201D). By accessing or using our Services, you agree to be bound by these Terms.

By creating an account or using our Services, you confirm that you are at least 16 years old and agree to comply with these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

Outfame Social, Inc. provides an AI-powered social media management platform that includes content creation, scheduling, analytics, and publishing tools. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Violate the terms of service of any connected social media platform
  • Upload or distribute malicious code, spam, or harmful content
  • Attempt to gain unauthorized access to our systems or other users\u2019 accounts
  • Use automated means to access the Services beyond our provided APIs
  • Resell or redistribute the Services without our written consent
  • Generate content that is defamatory, harassing, or promotes violence

5. Content and Intellectual Property

You retain ownership of content you create or upload through our Services. By using our Services, you grant us a limited license to process, store, and transmit your content as necessary to provide the Services. AI-generated content created through our platform is yours to use as you see fit.

Our platform, including its design, code, features, and branding, is protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our Services.

6. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as provided in our 14-day refund policy. We may change pricing with 30 days\u2019 notice. Failure to pay may result in suspension or termination of your account.

7. Free Trial

We may offer free trials of paid features. At the end of the trial period, you will be automatically moved to the free plan unless you choose to subscribe. We will not charge you without your explicit consent.

8. Third-Party Integrations

Our Services integrate with third-party social media platforms. Your use of those platforms is subject to their respective terms of service. We are not responsible for the actions, content, or policies of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, Outfame Social, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Services ceases immediately, though we will make your data available for export for 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
